1. OBJECT This document establishes the general terms and conditions (hereinafter, "TERMS") applicable to the use of commercial intermediation services and other services offered by FROM MOKA SAS (hereinafter, "THE SERVICES") through the website www.cafeeljerarca.com (hereinafter, "THE PLATFORM"). Any person wishing to access THE SERVICES must be subject to these TERMS and the other policies that govern THE PLATFORM.

2. ACCEPTANCE OF TERMS AND CONDITIONS By checking the box "I accept Terms and Conditions" or by browsing THE PLATFORM, the user (hereinafter, "USER" or "USERS") expressly agrees to adhere to a legal agreement with FROM MOKA SASIf the USER does not accept the TERMS, he/she must refrain from using THE SERVICES.

3. USER REGISTRATION AND CLASSIFICATION To acquire USER status, simply browse THE PLATFORM and make a purchase. You must provide accurate and up-to-date information, which will be validated. Any transaction made with your password or personal information will be valid and binding.

4. USER OBLIGATIONS The USER agrees to:

  • Pay for THE SERVICES in accordance with the TERMS.

  • Ensure the veracity of the information provided.

  • Do not facilitate the misuse of THE PLATFORM by third parties.

  • Do not introduce viruses or any other programs that may affect THE PLATFORM.

  • Do not access restricted areas without authorization.

  • Do not use THE PLATFORM for illegal purposes or purposes that are harmful to third parties.

5. PAYMENT METHODS Payments can only be made through the methods enabled on THE PLATFORM. The use of credit cards will be subject to the terms and conditions of each banking institution. THE PLATFORM will handle financial data in accordance with its privacy policies.

6. DURATION, MODIFICATION AND TERMINATION This contract has an indefinite duration. FROM MOKA SAS may modify the TERMS at any time, providing at least 10 days' notice on THE PLATFORM. The USER may request termination of their relationship if they do not agree with the changes.

7. SHIPPING AND BILLING The USER is responsible for providing a correct shipping address. Estimated delivery time is 2 to 7 business days. FROM MOKA SAS is not responsible for delays caused by third parties. International shipments are not made.

8. RETURN AND WITHDRAWAL POLICIES The USER may request a return of the product within the first 5 business days after delivery, assuming the shipping costs. For a return to be valid:

  • The product must be in its original packaging and unused.

  • Must include invoice and accessories.

  • It should not be a product for personal or intimate use.

9. WARRANTY POLICY If a product develops manufacturing defects within 30 days of receipt, the USER may request a warranty, which may include repair, replacement, or a refund. The warranty does not apply if the damage is due to misuse.

10.EXCHANGE POLICY Exchanges may be requested within 15 days of purchase. The product must meet the conditions established in the return policy. Exchanges are not available for promotional products or products for personal use.

11. EXCLUSION OF LIABILITY FROM MOKA SAS is not responsible for:

  • Damage caused by improper use of THE PLATFORM.

  • Computer failures, viruses or other events beyond its control.

  • Impersonation of USERS.

  • Losses arising from transactions between USERS.

12. INTELLECTUAL PROPERTY All content on THE PLATFORM, including trademarks, designs and texts, is the property of FROM MOKA SAS and is protected by intellectual property rights. Unauthorized reproduction or use is prohibited.

These TERMS govern the relationship between the USER and FROM MOKA SAS in the use of THE PLATFORM. By using it, the USER accepts all the provisions set forth herein.
